Throwing a Dean Under the Bus

UT’s President Lloyd Jacobs had some interesting comments that were made in email exchanges in the continuing story of the Arts & Science College that among them suggest throwing a Dean under the Bus:

“For several days I thought the best thing to do was to throw [Lee] under the bus and get on with our agenda,” Jacobs wrote to Rosemary Haggett, the university’s provost. “Maybe thats [sic] still the best thing – input please …

“However, we probably can’t do that because we can’t reward the bad behavior that the [Arts and Sciences] folk have displayed, I think.”

Toledo City Council Meeting July 1st…

Unfortunately due to technical problems beyond my control (the DVR did not record for some reason) I won’t have detailed notes on today’s Toledo City Council meeting. I will link to the media coverage out there and in watching Fox Toledo tonight I discovered that:

Amend lease with Ohio Cultural Facilities Comm. (OCFC) for COSI building, insurance & maintenance was approved, with Councilman Tom Waniewski making a statement against the continuing funding.

Today I walked into my boss's office. I said to him:

"Boss, I know your doing very well for yourself, but, I also know that overall the firm has been loosing money, and although we put out a great service and product to our clients, the PERCEPTION is that the other firms are doing it better."

"That being said, I would like your guarantee that regardless of overall firm profits I won't lose my job, my health care will remain the best in the country, and my wage -which greatly surpasses the national average and my skill set- will steadily increase on a known scale." He smirked.

"Oh and one more thing, I also need you to ensure that my dad (who retired from the firm 25 years ago and is the main reason I got this job) will still get his very lucrative retirement package till death. If you can't promise me these simple, all American things I worked so hard for, I'm gonna have to strike!" He smirked again, showed me a pile of applications from young, hard-working, new AassHole lawyers, and told me I had till 10:am to clean out my office.

Well, it’s technically not in Toledo, but in the Toledo area - this in via email:

We are very excited to announce the 2008 Strickland for Governor Cornhole Tournament Tour. Cornhole is a rapidly growing activity enjoyed by people of all ages and backgrounds. Unlike a golf tournament, our cornhole tournament will not require any equipment nor require any skill. It will be open and accessible to people of all ages and abilities.

There are two brackets of play for the tour: $50.00 per tournament for Singles play and $100.00 per tournament for Doubles play.

Today an editorial focuses on Why Scott should be saved in the Blade. It’s a recommended read for those of you following the Scott High School story and it also should be pointed out that:

The Ohio Schools Facility Commission of the Board of Education of the Toledo City School District, Lucas County, Ohio, will hold a meeting in room 309 of the Thurgood Marshall Building, 420 East Manhattan Blvd., Toledo, Ohio, 43609-1267, on Wednesday, July 2, 2008 at 1:00 p.m.

The OSFC Committee will meet for the purpose of discussing items for the special Board Meeting to be held on Tuesday, July 28, 2008 as well as to consider other items as may officially come before the Committee.

Toledo police kill another dog…

It should go without saying that no one wants a Toledo police officer or any police officer to be harmed by a dog. If it comes down to an unavoidable life or death decision of the dog over the officer it’s established practice that the police officer has the authority to shoot and kill the dog.

The police department’s manual states that officers may use a firearm to destroy “a dangerous animal that poses an immediate threat to the officer,” and also “a seriously injured animal where humanity requires its relief from further suffering.”

The question comes down to is enough care taken for it to be avoided. In yesterday’s incident, it is being stated that information was given to Toledo police that the person they were looking for no longer lived there.

Why was Debra Pioterek living in a shed behind Southwyck and Anthony Waters beaten to death…

While I don’t like to jump to assumptions, it seems clear from the reporting in the Blade that the 54 year old woman was living in the shed:

The body was covered with a blanket and lying on its side in an eight-foot shed with a missing door behind a business at 5225 Southwyck Blvd., near Reynolds Road. It was discovered about 8 p.m. by a local artist who was considering renting the building. Bags with women’s clothing and personal paperwork also were found in the shed.

Debra Pioterek once had a home, something happened where she ended up not only living in a shed behind an empty retail spot on Southwyck but dying alone of yet to be determined causes. Hopefully her death while alone was a much more peaceful one than happened to Anthony Waters in Cleveland who was beaten to death as cars slowed down to watch…

Type A Day Cares are the target of the Moratorium?

I wrongly assumed with the type of problems that District One Councilwoman Wilma Brown was describing that she was referencing Type B Day Cares, because Type A’s face quite a bit more regulations now. However, after reading parts of the legislation on Maggie Thurber’s blog it’s clear that Type A’s are the target of the proposed moratorium that appears to be headed before Council next Tuesday. What are currently the requirements? Glad you asked…

Portside as a Casino? Look at Detroit first…

The common thought by many seems to be, “Casinos are inevitable, it’s a way that politicians can raise taxes without raising taxes. It’s just like state lotteries.” Yet all we have to do is look up north to Detroit to be able to get some realistic hints as to what we could expect if gambling did become legal in Ohio and if Portside was made into a casino. One of the studies quoted often when it comes to the issue of crime, gives us a clue into other important information. Who would actually be spending money in a Toledo casino:

Concerts at Erie Street Market and that nagging selective history question again…

First what appears to be good news, Erie Street Market draws encore as concert venue and the City is expecting to earn $10,000 to $15,000 per event. The interesting side part of the article has my selective history warning bells going off again:

Mr. Croak, who operated the former the Main Event in East Toledo, has had legal troubles in the past. He was arrested in 2001 and accused of allowing underage drinking at the nightclub and operating a business where alcohol is sold or furnished in violation of the law.

He pleaded not guilty, and the charges eventually were dismissed six months later.

What’s interesting is charges that were dropped were focused on when it appears other things brought up back in 2005 by HistoryMike on Toledo Talk where it looks like there was a guilty plea, don’t get mentioned.

Hence the creation of a new category, “Selectively”…

The Truth: Courage when it comes to Scott High School and more….

As always when I sit down to read the Sojourner’s Truth I head for the “This Strikes Us” column to see what the editorial opinion is this week. Sometimes it touches on one topic, others like this week it covers more than one. The main focus is on Scott High School situation part of which:

This one was pretty easy to forecast – the community would want renovation of the historic building and the whole issue of delaying any sort of improvement of the building for so long would cause a great deal of consternation.

On the other hand, funds are limited. We always knew this would have to be a problem in the latter stages of the building program. And as student populations continue to dwindle, it seems as if the administration has deliberately stalled to see if the student population for Scott would simply disappear altogether. It hasn’t.

Toledo says Marina District bonds won’t alter debt limit…a simple question…

It sounds logical when you read this in the Blade, Toledo says Marina District bonds won’t alter debt limit especially this part:

Fran Song, Toledo’s debt management officer, said the general obligation bonds included in the financing structure would be paid off through assessments on Marina District property and not affect the city’s ability to borrow.

City Council yesterday reviewed the Finkbeiner administration’s request to issue $8.2 million in notes for the project, which includes a riverfront roadway and park.

Temporary order halting Toledo’s convenience store licensing law granted…

As reported as an update to today’s Blade, Judge grants temporary order halting Toledo’s convenience store licensing law.

The date for the next hearing has not been announced but as it stands now:

A federal judge sided with a group of convenience store owners Tuesday morning and granted a temporary restraining order against Toledo’s new law that licenses the establishments.

U.S. District Judge James Carr granted the motion after three convenience store owners testified against the new law.

Scott High School and what’s next…Updated!

There has not been a lot of attention in the main stream local media about Scott High School and whether the decision made is going to be to renovate, build a replacement or do nothing. For those of you interested in what’s happened recently, an article written on June 3rd in the Toledo Journal is a recommended read for some of the background information. There is also an updated report on the Urban Coalition website as to a OSFC committee meeting that took place on June 19th.

More information on what the exact decision will be is expected soon…As an update after I posted this article I received an email that shares an article written in the Midwest Urban News along with another link asking the question:

“Why is there so much concern for the Seneca County courthouse, resulting in many articles in the Blade, while there appears to be very little, if any, concern for a historic building and institution right here in Toledo that is on the chopping block.”

Malls and the green grass of the burbs affect on Downtown Toledo…

The Blade is beginning a series looking at our Downtown Toledo and the other large Cities in Ohio and how they have faced challenges with job loss and a decline in their downtowns. What I found most interesting is not all of the jobs just disappeared, as the first article in the series points out:

In Toledo, O-I’s move to Perrysburg from downtown in 2006 removed about 350 employees who helped keep cash registers chirping at restaurants and shops in the city core.

TFP: Weathermen, babies, just build it and more…

I love stormy weather, some of you know one of my dreams is to be a storm chaser and to actually get video of a tornado, so I love Weathermen or as they are officially called, “meteorologists”. I love to look at the different radars, talk to my television screen when they are wrong and hope those huge red areas demonstrating a circular rotation come close enough to enjoy but not overly damage…It should be no surprise then that the cover story of this week’s Toledo Free Press titled, Stormy weather puts spotlight on local forecasters was one I enjoyed. Getting all four of the chief meterologists from Toledo’s news stations was quite a feat.

Conklin & Company, Richard Cordray, Glass City Jungle & Take Three

Current Ohio Treasurer Richard Cordray was in Toledo to talk about Consumer Credit issues and sat down to do an interview with Lee Conklin of Conklin & Company which is seen on WTVG. Cordray stated that they are making a push in Ohio as far as sharing information that help is on the way when it comes to making practices used by credit card companies more pro-consumer. That it was something that the federal government had been igorning for quite some time and have no made some pro-consumer rules, he gave the example of companies shortening their payment cycle which they would now be required to give each consumer 21 days.

Cordray has gone to other cities in Ohio to get comments from Ohioans and will continue that, there is also a website where you can share your thoughts and get more information, yourmoneynowonline.org.

Judge Kuhlman is right, it’s cheaper to pay $6.00 a week than to lock people up…

I do believe in a level of fiscal responsibility, but I also believe that it should be based on priorities and a bottom line of what option is more fiscally responsible. I agree with what Judge Kuhlman stated about the City continuing to pay for drug tests for those out on bond that costs $6.00 a day is a better option than locking them up or forgoing drug testing which is another option.

First pit bulls now day cares…

Back in April, it was reported:

“We have puppy mills for pit bulls in the city of Toledo,” said Councilman Wilma Brown, who presented the ordinance yesterday. “If the owner loves this animal and wants it back, they will pay to have it spayed, which it should be anyway.”

Then at the Toledo City Council meeting of, May 6th, I reported:

Amend TMC Sec 505.14 requiring any Pit Bull dog seized must be spayed or neutered before returned

Frankly I was surprised this passed with no discussion, but everyone but Betty Shultz voted yes on it.

I thought I was the only one who was surprised about what happened at this week’s Toledo City Council meeting where during the first call, District One Toledo Council Woman Wilma Brown stated she wanted legislation to be drafted for day care businesses that she felt they were becoming like carryouts that they are where they really aren’t needed and they’ve become like a business, she wants legislation to create a moratorium until they could look at some of these that they are ruining their residential neighborhoods by having little ones dropped off early in the morning and not picked up till late at night with the music blaring.

Truth: Obama victory will erode support for affirmative action & more…

In this week’s The Sojourner’s Truth the focus of the “This Strikes Us” column is the belief that an Obama victory will substantially erode support for affirmative action.. Some thought provoking poll numbers and other facts are presented in this article that is a highly recommended read.

Toledo City Councilman Michael Ashford sees fields of greens where they shouldn’t be and more detail is gone into about his belief that his District is not getting the level of services that it’s residents are entitled to. Ashford made this point also during the recent City Council meeting during the first call portion of the meeting.

Lucasville 5 and the forgotten victims…

The Blade reports that the Ohio Supreme Court has upheld the death penalty conviction of James Were. Were is a former Toledo resident who was originally sentenced to Lucasville and after the riots when he was charged with the murder of Corrections Officer Robert Vallandingham and found guilty, given the death penalty, the Ohio Supreme Court in 2002 ordered a new trial since there were questions related to Were’s comptency and a competency hearing was not held.

If you believe the prosecution, Were was a huge part of the actual Lucasville Prison riot in 1993, if you believe the defense, Were could barely read or write and has an IQ of 69 or 70. The only real evidence that is stated to exist is tapes recorded during the riot in 1993 where even there conflicting evidence exists as to who ordered the murder of Corrections Officer Robert Vallandingham and what role Were had in the prison riots.

Reaction to Szollosi legislation on Marina District beginning and more on Council actions

Some are calling Toledo Councilman Frank Szollosi’s proposed legislation a “deal killer” that would require workers hired for the Marina project to be from local unions. Fox Toledo reporter Shaun Hegarty was at the earlier Toledo City Council meeting. The letter the Mayor wrote to Council is on their website.

“The public has an investment and we owe it to the men and women of local labor who give so much to our community in taxes, and so many other ways the opportunity to bid on this work and receive it,” Councilman Szollosi said during Tuesday’s session.

NBC24 reported on the vacant house registry. As did Shaun on Fox Toledo in a second story on what was before Toledo City Council today.

At least 11 of Karyn McConnell Hancock’s cases have discrepancies

I almost dread posting this with what normally happens, but? It’s news and it is something that has been of huge interest to the local blogging community, as reported in the Blade, Investigation shows 11 clients of McConnell Hancock had money missing from estates:

At least 11 of Karyn McConnell Hancock’s former Lucas County Probate Court clients have discrepancies in their accounts totaling more than $170,000 in missing money and possible thefts, a recently concluded investigation revealed.

The “big items” related to the Marina District were near the very beginning of the Council meeting - all were held until the July 1st meeting:

Establish Tax Increment Financing (TIF) area for Marina District, require payments in lieu of taxes
Cooperative, Construction Management & Agency Agreements with Port Authority, Dillin & Bank of NY
Resolution - Assessment for Riverside Dr., lighting, sidewalks and clock tower in Marina District

Toledo Free Press - Fired up and ready go to…

If you have ever attended a political rally, the phrase “Fired up and ready to go” is one often heard, but in this week’s Toledo Free Press, the term “fired up” has a different meaning, the cover story focuses on the Smoking Ban and how the Senate introduced Bill 346 would give some of the decision making process on smoking versus non-smoking back in the hands of some of the business owners as it was felt the original voter approved issue was supposed to provide.

It’s always hard for me to acknowledge compliments, but after I read Michael Miller’s piece it confirmed for me that I’m doing what I need to do. Some of you won’t agree, but I found the Captain Ahab quest for power ala Lucas County Republican Party a good read. Karl Rundgren focuses on beyond intermodal and raises some excellent points about moving more than just freight. Related to the topic of intermodal, it could be said that Lucas County Commissioner Ben Konop is “fired up and ready to go.”

Republican says she’d vote for the devil…

If you ever wonder what could be behind some of the decision making processes of our Toledo City Council members? This quote from the Blade article, New Marina District plan garners council support, TPS ire shows you how one thinks:

“I would vote for the devil in cloven hooves if it would bring jobs to Toledo,” Councilman Betty Shultz said.

Surprising considering it will not only cost the City more but could affect the City’s ability to do any future bond projects.

Originally the City of Toledo was only supposed to have to come up with ten million dollars for the park aspect of the project and in return Dillin would contribute ten million dollars and be given the 58 acres of property. Now, Dillin is only coming up with 3.6 million dollars rather than ten million and instead of the land being “given” to him with the value it currently has, it will be listed as it is being sold to Dillin for the 3.6 million dollars.

Random ponderings related to our local government…

A few random things that I’ve been thinking about, if the position of the City and some on Council is now that Toledo should keep it’s word when it comes to paying Lucas County for the work done to create Technology Road in Monclova, then why was it okay to suggest that the City require police officers to stop citing city ordinances when making arrests and begin citing state laws only, which would require the county to pay for booking prisoners into the jail that would have increased costs to Lucas County by $2 million dollars? There didn’t seem to be that much concern as to what that would financially do to the County during the budget process.

Why are Toledo police officers used to deliver information to Toledo Council members late at night? Wouldn’t it make more sense to create these documents in an electronic format and share them that way? Wouldn’t that be more cost effective and make sure that Toledo Police Officers were not taken away from their own duties?

Marina Project, “more risk and debt”

The Marina District financing has become even more complicated with the blame being levied at the Toledo Public School System for not wanting to agree with the proposals that have been presented by the administration thus far. In reading today’s Blade questions come to mind on this. It’s been previously reported that the TPS share of the tax dollars with no abatement would be 25 million dollars over the course of 15 years. The article also seems to indicate that the previous documentation that Larry Dillin was to provide demonstrating he had the necessary financing in place will not be coming until prior to closing:

The funding strategy is complicated, the mayor admitted.

The city intends to issue $6.75 million in five-year notes with an interest rate starting at 2.5 percent annually and increasing to 4.5 percent by 2012.

The Finkbeiner administration is planning to shoulder more risk by issuing $8.71 million in 20-year general obligation bonds in 2012. That amount is expected to be sufficient to pay off the five-year notes and accrued interest.

WSPD & Brian McMahon’s intermodal presentation.

I had previously seen the slide show thanks to WSPD giving it to Chris Myers who shared it on SwampBubbles but tonight was the first time that I heard the actual presentation that was made with the slides. WSPD will be covering this in even more detail tomorrow morning, Fred has a post up on SwampBubbles and Chris stated he has video that will be up tomorrow for those of you who did not attend tonight, so I recommend checking that out to make up your own mind on this topic.

The “breaking news” aspect of tonight was learning that there appeared to no longer be an issue related to the water lines that Brian McMahon’s company had purchased some additional land that allowed them to be able to access water lines. Fox Toledo had Shaun Hegarty there tonight so check their website later for video on the story.

Only two Toledo City Council members were in attendance tonight, District 2’s D. Michael Collins and District 6’s Lindsay Webb. Rep. Randy Gardner arrived after the presentation began. Some of the links in this older post here might be of interest if you did not read about them before.

The Mayor on intermodal and more…

Today on Troy Neff the Mayor talks about his belief on the topic of intermodal and WSPD.

He states the focus should be more on alternative energy and we are the solar energy capital of the US rather than concentrating on intermodal especially with energy prices. I recommend listening to the interview which also references a Blade article from today and several other recent articles.

Toledo, Monclova and the road that was never approved…

When you read the Blade article on the creation of Technology Drive and the County wanting to be reimbursed $560,980.00 one thing isn’t mentioned. While a deal was made in 2005 for a joint cooperation agreement with the county for the roadway’s construction, it does not appear that was ever approved by Toledo City Council. When this came up last year for a vote, it ended up being tabled.

If you listen to the interview that Troy Neff had today with Councilman Joe McNamara you’ll discover that and some other details about this scenario.

For some history on the actual Monclova land purchase? A great article by former Blade reporter, Joshua Benton. I recommend reading the article in full, here is a small bit of the history:

In 1987, Toledo joined the long list of dreamers who looked to Monclova’s open spaces as a way to make money. Toledo’s mayor at the time, Donna Owens, and then-City Manager Phil Hawkey, secretly agreed to purchase 1,187 acres in Monclova Township hoping to annex the land into the city, develop it for business and industry, and bring more taxes into city coffers.

City of Toledo responds to Midwest Retailers Association…

Today, the City of Toledo responded to the Midwest Retailers Association request for a preliminary injunction on the Toledo “Convenience Store” Ordinance. In its response, the City of Toledo explains that the “Convenience Store” Ordinance actually governs all Food and Beverage retail stores smaller than 5000 sq ft. of floor space and that only a portion of the establishments governed by the law have received their applications. The vast majority of these establishment are unaware of their impending obligations.

TPS offers compromise deal to Toledo over Marina issue

Fox Toledo has the story from last night:

John Foley, Toledo Public Schools Superintendent, and other school district leaders have extended an olive branch to the City of Toledo in helping reach a deal over the marina district project’s tax sharing impasse.

Municipal Court does have afternoon sessions…

I was listening to the two interviews that Troy Neff did with Michael Collins and Judge Kuhlman. I recommend you listen to both but at one point of the interview Councilman Michael Collins states that there is no afternoon sessions at the Court, I thought this might be incorrect because I remember afternoon court times in some of my searching and being at court with friends/family members.

There are afternoon sessions at Toledo Municipal Court, it’s listed on the daily docket that is on the Clerk of Courts website. Court is scheduled at 8:30 a.m. and again at 1:00 p.m. with various other hearings scheduled in the afternoons, some at 2:30 p.m. and even one that I noticed at 5:00 p.m.

I can’t attest to the other statements Councilman Collins made as to how many hours per day the Judges put in, but there is afternoon court scheduled every day in more than one courtroom. The Board of Elections does not have the most current election finance forms on their website, they only have 2005 and 2006, however in going through the files online of the Judges currently in office only one received money from any branch of the UAW, Judge Schaefer received $3,000 in 2005 from the Ohio State UAW Pac. I will get the records for 2007 as soon as possible and look through them. Why that could be more relevant is the Lucas County Sheriff non-command officers voted to join the UAW in 2006, they were formerly represented by the Ohio Patrolmen’s Benevolent Association.

Amnesty proposal for nuisance properties?

It sounds like an interesting suggestion that might have a small impact on helping the City to collect some of the $4.1 million billed to current and former property owners from the past two years as reported in the Blade. The tax amnesty program was successful, yet, it’s hard to ignore that this is a bit different of a scenario as is pointed out:

The low collection rate is because of difficulty finding property owners, Ms. Bond said.

Even if the city does locate the owner and obtains a court order to pay up, it’s still easy for a reluctant property owner to claim he has no money.

Toledo Municipal Court Judges file order on Court House Security…

Fox Toledo has the story as well as the link to the letter written to The Mayor and City Council President. The order is also included in that pdf, which I recommend reading, the most important part of the order states:

It is Therefore Ordered, Adjudged and Decreed that the Mayor of the City of Toledo and Toledo City Council shall make the following appropriations for the Toledo Municipal Court for the purposes of entering into a contract with the Lucas County Commissioners and the Lucas County Sheriff’s Office to provide court security, court bailiff services and prisoner transport services for the fiscal year 2009. The Court orders that the Mayor of the City of Toledo execute a contract and that the Toledo City Council approve that contract between the City of Toledo and the Lucas County Commissioners for court security, court bailiff services and prisoner transportation to be provided by the Lucas County Sheriff’s Office to the Toledo Municipal Court for the calendar year in the amount of $1,951,789.65. That dollar amount represents the 2008 budget proposal from the Lucas County Sheriff’s Office for 23 deputies and one sergeant, plus a 3% cost increase, which is less than the cost increase provided by the most written contract executed December 31, 2004. So Ordered.

It was signed by Presiding Judge Timothy Kuhlman, Judge Amy Berling, Judge Robert Christiansen, Judge Francis Gorman, Judge Michael Goulding, Judge C. Allen McConnell and Judge Lynn Schaefer.

Councilman Waniewski’s statement on vacant home ordinance…

This information was included in the most recent newsletter sent out by District 5 Councilman Tom Waniewski:

City Council will consider an ordinance requiring owners of a vacant residential property to register their properties. As of this writing, I am not in support of this ordinance. Because so much can be misconstrued in a 10 second sound bite, I wanted to explain my reasoning.

While I applaud the hard work of the city’s department of neighborhoods, I feel the registry forces an unnecessary burden on law-abiding, tax-paying, property-respecting individuals. There are many exemptions for NOT paying the initial $100 fee, however I believe it adds another layer of government beuracracy to home ownership. The burden of proving that your home should be exempt from this fee (you are selling it, you are living in Florida for the winter, etc.) is on you.

Muni Judges Versus the City and looks like I was right about recycling…

The battle between the Toledo Municipal Court Judges and the City continues over the topic of who will provide security for the court house as noted in this Blade article. The City wants to get rid of Lucas County Sheriff’s doing the security either all or at least some since it’s reported that with salary and benefits and overtime they make over $80,000 per deputy to provide court room security and security at the Court House.

The Judges say “no way” they don’t want part time security, especially part time retired saftey officers in their courtrooms. I can see both sides of this issue, as one example, I can see utilizing part time security staff to run the metal detectors at the front door, typically there are three to four deputies there and it’s hard to argue that this could not be done by someone else. Yet with the huge volume of cases the Municipal Court judges have, I can also understand why they would want a full time security person assigned to their courtroom. If you have ever spent any time down at the Muni Court, it’s crazy down there at times, extremely long waits, tempers flaring, victims and accusers in close proximity, etc.

Finally some attention to Neighborhood Housing Services

Neighbors over on St. Louis Street have been complaining for years about two properties owned by Neighborhood Housing Services and as you can see by the Blade article nothing has been done. The ultimate irony in this is that Neighborhood Housing Services is listed on the brochure that the Toledo Housing Court puts out as a resource see for yourself on page four. Ironic considering they don’t seem to follow the law nor do they seem to have to be held to the same standard as everyone else.

A glaring example:

Kattie Bond, director of the city’s neighborhoods department, said nuisance abatement had issued orders on 505 St. Louis St. as early as 2003 and in July, 2005, issued orders to board up the house.

Bob Reinbolt says TPS may get nothing and deadline passes for Dillin to provide letter of credit

I recommend listening to Bob Reinbolt on the Troy Neff program this morning on the TPS versus the City on the abatement issue. (School Board members Bob Vasquez & Lisa Sobecki were also both on.) Bob Reinbolt does clearly state that TPS could get nothing, “if we are at a point where we can not move forward then there are some other options that we need to take a look at, and unfortunately out of that TPS may get nothing from that.” He then immediately adds, “Well they would certainly still get the development and eventually they would get property taxes there.”

That raises some questions for me, in doing some searching on Community Reinvestment Areas and School systems on the topic of tax abatement I came across this opinion from the Attorney General’s Office, that does seem to address part of this topic included as a part of the opinion:

TPS & City of Toledo millions apart…

THe City of Toledo is offering the Toledo Public School District in the lastest offer according to the Blade:

The city’s offer sent yesterday included a 50 percent split on income tax earned on the site and $500,000 annually for five years to pay for capital improvement projects in the neighborhoods surrounding schools.

The district also would begin to receive income from property taxes on the land values exclusive of improvements.

Toledo Public Schools asked for 1.25 million in cash each year for 15 years and an additional 900,000 each year for 15 years. The earlier offer from the City was stated to be a total of 7.5 million, no dollar amount in total was given as an estimate for this latest offer. However, it’s clear if you take 1.25 million plus 900,000 times 15 years? The two sides are millions of dollars apart.

Southwyck to close June 30th…

On Monday I went to Southwyck with my oldest daughter and saw two stores that were open not long ago, Ladie’s Foot Locker and Victoria Secret were closed, I also saw that Deb’s had a going out of business sale sign and talked briefly with a UPS driver who was loading up box after box of merchandise that the store did not want to clearance out that is being sent to other stores in the area. He told me that it’s been a busy week since he’s been doing the same thing for other stores in Southwyck Mall. I had not heard anything official but wondered if the recent “black mold scare” had driven off what was left of those who shopped at Southwyck.

Councilman Michael Ashford raised the question at the Toledo City Council meeting the next day, he had been told that stores had received notification that they had to be out at the end of the month. Apparently, any stores left in Southwyck have been ordered to leave before June 30th because according to WTVG Councilman D. Michael Collins is stating that stores have received notification of the closing.

Toledo Board of Education voted 4-1 to approve fact finder report

Steven Flagg was at the meeting this morning, there are notes and audio on the tpsinfo.com website. The pdf for the fact finder report is also linked there. It has been reported as well in the Blade that the fact finder report was voted on this morning and was accepted four votes yes, one vote no. School Board members Jack Ford, Lisa Sobecki, Steve Steel and Bob Vasquez voted yes, Darlene Fisher voted no.

The Mayor, SB 260 and it seems like it’s about Rick Jones…

The Mayor is going to join Baldemar Velasquez, President of the Farm Labor Organizing Committee at 5:00 p.m. today on the steps of the Student Union to oppose S.B. 260. It’s being stated the reason for the opposition is:

S.B. 260 would require the Lucas County Sheriff and the Toledo Police Department to provide direct aid to federal immigration officials in the enforcement of deportation laws and laws prohibiting the hiring of illegal immigrants. Not only is this a unfunded mandate from state government, but it could lead to increased targeting and profiling of Hispanics by local law enforcement. Mayor Finkbeiner will join local Hispanic leadership in opposition to this bill which has already passed the Ohio Senate and is pending before the Ohio House of Representatives.

I think it’s a bad bill for a variety of reasons, however, if you read the actual Fiscal Note & Local Impact Statement for this bill, it does not appear as if it is an unfunded mandate since it would require a further action on the part of local government, two specific parts:

Assets Toledo - an inspiring way to start out my morning….

Yesterday I had a chance to talk to Olivia Holden about her involvement with Assets Toledo because they were holding a fundraising event this morning at the Toledo Club which she invited me to. Now those of you who know me, know I’m not a morning person, however what I heard this morning was a very inspirational way to start my day. The focus was on what this program gives people, which is a chance to develop/continue/enhance the entrepreneurial spirit that our society and our economy needs and survives as a result of.

From the Welcome by Olivia Holden to the Invocation given by Bishop Tisdale, the history shared by Frank Ulrich, the sharing of some of the successes by Maynard Sauder, thoughts shared by Dan Anderson, Lillie White and Jason Daniels sharing their personal experiences of what they gained from the program, Dick Anderson stressing why this program deserves community financial support to Frank Ozanski’s closing, the thought that ran through my mind was “imagine the possibilities”.

The Truth: Fact finders, Judicial speculation, stop being skurred & more…

This week’s Sojourner’s Truth has some serious moments and some light ones to point out. There are two parts to the This Strikes Us, the second part focuses on presidential politics but the first one focuses on the recent fact finder report approved by the Toledo Teachers Union. The suggestion to Toledo Public School Board members:

The fact is, we have a demand for teachers and a short supply of really good ones. That is really the important issue. If we want to increase the supply, we need to increase the compensation. That’s Econ 101 … basic Adam Smith stuff. Market rate is the market rate.

We trust that the school board will approve the fact finder’s report including the recommendations for future teacher pay raises.

Media on last night’s City Council Meeting…

The heading selected for Fox Toledo made me envison clouds parting and the sun smiling down on the Marina Project….Council blesses Riverwalk plans which is even more appropriate considering some believe it will be a miracle if the project does succeed.

Ignazio Messina reports on yesterday’s Council meeting for the Blade, with the main focus being the TetraTech/Riverwalk plan.

NBC24’s Aaron Brilbeck reports on the meeting as well sharing some comments from City Council members one that has not really been focused on as a topic is related to the second sentence:

“Anytime in the next 12 months, Tetra Tech could decide that the deal is not in their best interest, and back out,” Collins said.

Collins tells NBC24 that Tetra Tech has expressed concerns about the cost of cleaning up Swan Creek.

Toledo City Council Meeting May 20th

The first 40 minutes of today’s Toledo City Council meeting was mainly focused on resolutions, Resolution - Recognize Veterans Honor Flight of Northwest Ohio - Resolution - Recognize Sgt. Richard B. Murphy - Resolution - Employer support of National Guard and Reserve and the Delegation from China was recognized and spoke briefly.

Council President Mark Sobczak was not in attendance and neither was Council person Betty Schultz. Councilman Szollosi and Councilman Sarantou left before all of the agenda was gone through. It was probably one of the shortest council meetings on record that I’ve covered recently though I don’t believe it was the shortest meeting on record…What follows is some of what was discussed/voted on that I thought might be of interest, there was very little discussion tonight on any of the items before Council. Councilman Craig was the temporary Council President for the purposes of the meeting.

A semi-win for Northern Ohio on turnpike issue…

As reported in the Toledo Blade, Turnpike funds for state jobs plan cut in half which is a semi-win for Northern Ohio. A complete win would of course be if what was originally promised when the turnpike became a toll road in the first place that was voter approved was reversed, but I don’t think that will ever happen. As many know, originally when the initial bond issue was paid off the turnpike was supposed to stop being a toll road. However the General Assembly changed that in crafting this back in the 1990’s:

§ 5537.21. Continuance as toll road after debts paid; fixing and use of tolls.

City resident has a City Council experience that was less than pleasant…

I’ve gotten the text of an email that was written to all members of Toledo City Council that was in reaction to an experience a Toledo area resident had with the over all tone of the meeting and in discussion with Councilman Mike Craig last night. Some of the local media was given a copy of the email, not by this person but by another member of Council, George Sarantou. Communication with all of Council is public record, yet most times this type of communication shared with the media is done by those involved.

Dear Mr. Craig:

I attended the Coucil meeting on Monday, May 19, 2008 at 4:00 pm with the intent of requesting City Council to find the needed funds to take care of the median strip that is so desperately needed at the new Bowsher High School for safety purposes.

Little did I know that I was to witness the display of unprofessionalism that I did as well as be offended by a councilman.

City Council and more versus the Diversion of Turnpike Funds….

In addition to Peter Ujvagi who stated he has some major concerns about the diversion of funds and Matt Szollosi who were both on Troy Neff this morning, and the press conference that was held earlier today as well as the Mayor urging cities in Northern Ohio to join in protesting this…I’ve received the text of a resolution that will be presented by Councilman D. Michael Collins tomorrow for approval by Toledo City Council:

Opposing the change in the Ohio Revised Code, which would allow for the redirection of Turnpike Revenue to be distributed to projects not associated with the Turnpike; and declaring an emergency.

WHEREAS, Governor Strickland has requested in his $1.7 billion Economic Stimulus package, lawmakers to change the Ohio Revised Code which restricts the use of Turnpike Revenue, and opens those funds to uses not associated with the turnpike; and
